Terms of service

These terms govern access to wholisphere.ai, app.wholisphere.ai, cdn.wholisphere.ai, the Wholisphere browser extension, the embed script, the MCP server, and any API. By using any of these services you agree to these terms.
Acceptance
Using the service means you accept these terms on behalf of yourself and any organization you represent. If you don't accept, don't use the service.
Service description
Wholisphere provides AI-mediated accessibility tooling. We do not represent that the service makes any third-party website fully WCAG-compliant. The service mediates access via an agent and produces conformance reports for the customer's products based on data the customer supplies and analysis the service performs.
Acceptable use
- Don't reverse engineer the service or attempt to extract proprietary models.
- Don't deploy the embed on sites you don't own or have authorization to deploy on.
- Don't use the agent to scrape, spam, or impersonate.
- Don't submit content that violates law or third-party rights.
Billing
- Subscriptions renew automatically. Cancel anytime via the Customer Portal.
- Refunds within 14 days of first payment, prorated for unused time.
- Past-due accounts may have rate limits or service suspended after 14 days notice.
Liability
Service provided "as is." We aim for 99.9% uptime on Platform but make no other warranties. Liability capped at amounts paid in the prior 12 months. Wholisphere is not liable for downstream legal claims arising from a third party's accessibility-related conduct on the customer's product.
Termination
Either party may terminate at any time. On termination, data is retained for 30 days for recovery, then permanently deleted (except records required by law).
Governing law
Delaware, USA. Disputes resolved by arbitration in San Francisco, CA, except for IP claims.
Changes
We may update these terms; material changes get 30 days notice via email. Continued use after notice constitutes acceptance.
